Legal
Terms of use.
Version: 14 October 2026 · In case of any discrepancy, the German version prevails.
These terms govern access to the website immosmile.ch and the use of the content and online tools offered on it by Immosmile GmbH, Bahnhofplatz 1, 8001 Zurich («Immosmile», «we»). By accessing the website you agree to these terms, the Privacy Policy and the Cookie Policy. If you do not agree, please refrain from using the website.
1. Scope
These terms apply to the use of the website and its online tools. They do not apply to Immosmile's brokerage services – in particular on-site valuation, marketing and sale support: those services are governed exclusively by a separate written marketing mandate, which you receive in advance, can review at leisure and which sets out all conditions transparently. A free valuation that we provide before or without such a mandate is a market assessment within the meaning of section 3.
2. Information purposes, no offer and no advice
The content of this website serves general information. It constitutes neither a binding offer nor legal, tax or financial advice. Properties presented, and their details, are non-binding invitations to contact us («invitation to treat»); details become binding only in the contract documents intended for that purpose. We strive to keep content correct and up to date but give no warranty.
3. Calculators, assessments and guides: no advice, no warranty
Our online tools and content are meant to help you understand your situation and ask the right questions. They do not replace a review of your individual case. So that it is clear what you can expect, the following applies.
3.1 What our tools and content are
- The calculators (e.g. for property gains tax and net proceeds, care home costs, imputed rental value, early repayment charges, division of an estate, affordability and purchase costs) provide non-binding estimates. They work with your inputs and with the bases, reference dates and simplifications stated on the respective page. A result is only as accurate as these inputs.
- Initial assessments and online valuations are based on your details and publicly available data. They are a first orientation – not a market valuation in the sense of a formal appraisal (e.g. for a bank, a division of an estate, a court or a tax authority) and no assurance of an achievable price.
- A free valuation after a viewing is a careful market assessment. It is likewise not a formal appraisal and no assurance of a price, unless we agree otherwise in writing.
- Guides, information sheets, tables and comparisons are general information as of the date stated.
- The home check provides context for your situation and is not a recommendation to enter into any particular transaction.
3.2 No advice
Our tools and content are not tax, legal, financial or investment advice and do not replace advice from a professional for your situation. Immosmile is an estate agency – not a tax adviser, law firm, bank or notary.
3.3 What is binding
Only the assessments and rulings of the competent authorities, the entries in the land register, the notarial deeds and the contracts and offers of banks, care homes and other parties are binding.
3.4 Reference dates and changes
Laws, tariffs, municipal tax rates and the practice of the authorities change. Our content reflects the date stated in each case. We update it carefully, but not always immediately. Please therefore note the reference dates.
3.5 No warranty
We prepare our calculators and content with care. We check the calculation methods against the stated bases, such as the legal text, and, where available, against official examples. However, we give no warranty that results and information are correct, complete and up to date or that they apply to your case.
3.6 Your decision
Decisions you take on the basis of our calculators, assessments or content – for example on selling, buying, financing, dividing an estate, taxes or care – are your own responsibility. Before you decide, we recommend having your case reviewed by a professional, such as the tax office, a tax adviser, a notary or your bank. No contractual claims against Immosmile arise from the results of the online tools.
3.7 Liability
To the extent permitted by law, we are not liable for damage arising from the use of our calculators, assessments and content or from reliance on their results. Liability for unlawful intent and gross negligence (Art. 100(1) Swiss Code of Obligations) remains reserved, as does any further liability that cannot be excluded by law. Section 9 applies in addition.
4. Obligations of users
When using the website you undertake:
- to provide truthful information and not to submit third-party data without their consent;
- not to misuse the website – in particular not to introduce malware, circumvent security mechanisms or use the forms in an automated way;
- to use the content, calculators and data of the website only within the limits of section 5 – in particular not to systematically extract («scrape»), reproduce or commercially reuse them without our written consent.
In the event of violations we may restrict or block access to the website without notice and reserve further legal action.
5. Calculators, data and content
A great deal of our own work goes into our calculators, data collections, texts and fact sheets. They are there to help you with your decisions – and you are welcome to use them for that. So that this can remain the case, the following rules apply.
5.1 What is protected
- Our calculators – for example on property gains tax in the individual cantons, care home costs, imputed rental value, early repayment charges, affordability and purchase costs: their program code, their user guidance and the specific implementation of their calculations.
- Our data collections – for example municipal tax multipliers, care home rates and cantonal comparisons: their selection, verification, preparation and arrangement. Official source figures remain free; you will find them at the authorities. What is protected is our compilation.
- Our texts and design – guides, fact sheets and other downloads, graphics, tables, photographs, films, logos, trademarks and the look and feel of the website.
This content is protected in particular by the Swiss Copyright Act (URG) – the calculators as computer programs (Art. 2 para. 3 URG), the data collections as collective works (Art. 4 URG) – as well as by trademark law and the Swiss Federal Act against Unfair Competition (UWG). The rights belong to Immosmile or the respective rights holders.
5.2 What you are welcome to do
- use the calculators and content for your own decisions, as often as you like;
- print or save your results and discuss them with your family, bank, tax adviser or notary;
- download fact sheets for personal use;
- share links to our pages, including in the media, forums and social networks;
- quote short passages within the limits permitted by law, citing «immosmile.ch» as the source with a link.
5.3 What requires our written consent
Without our prior written consent, you may not:
- systematically extract, collect or store content, data or calculation results – automatically (for example with scrapers, bots or scripts) or manually –, in particular in order to build your own collection, database or directory (section 5.4 remains reserved);
- take over calculators, data collections, texts or fact sheets in whole or in substantial part, or build them into your own websites, calculators, apps, products or databases – including in modified, translated or reworded form;
- replicate or reverse-engineer our calculators or their calculation logic, or have them replicated – including with AI tools, for example by giving pages, source code or results to an AI program as a template;
- use content, data or code to create, train or improve AI models, datasets or programs that replicate or replace our calculators, data collections or texts (scientific research under Art. 24d URG remains unaffected);
- embed calculators or content in third-party websites (framing) or offer them under your own name;
- circumvent technical safeguards or access limits, or remove source and rights notices.
5.4 Search engines and AI answer services
We want to be found. Search engines and AI services may crawl our public pages in accordance with our robots.txt, make them discoverable and reproduce them in their answers with a source reference. This permission applies to these purposes only. It does not entitle anyone to take over or replicate our calculators, data collections or texts in an offering of their own (section 5.3).
5.5 Property materials
Property materials (e.g. exposés, photos, films) may be used solely to assess your own purchase interest and may not be passed on to third parties.
5.6 Consequences of unauthorised use
Unauthorised use generally infringes copyright and unfair competition law. We reserve the right to enforce our rights under civil and criminal law – in particular by seeking injunctive relief, removal, information, damages and surrender of the profits made (in particular Art. 62 and 67 URG, Art. 9 and 23 UWG). For the amount of damages in the case of commercial use without consent, we refer in particular to the licence fee that would have been appropriate for authorised use. We use technical means to detect and document automated access and the copying of our content, and may block access.
5.7 Licences and cooperation
Would you like to use one of our calculators, our data or texts on your website, in your advisory work or in your product? We are happy to find a fair solution. Please write to us at info@immosmile.ch.
6. Third-party links and services
The website may contain links to third-party websites and third-party services (e.g. property portals, appointment booking, embedded videos). The respective operators are responsible for the content, accuracy, functioning and data protection of those offerings; we accept no responsibility for them. Use of such offerings is at your own risk and, where applicable, subject to their own terms.
7. Availability and changes to the website
We strive for uninterrupted operation but do not guarantee it. Maintenance, further development, disruptions or force majeure may lead to interruptions. We may change, supplement or discontinue content and functions of the website at any time.
8. Electronic communication
Email and other unencrypted electronic channels carry risks (e.g. loss, delay, interception by third parties, viruses). To the extent permitted by law, we accept no liability for damage arising from the use of electronic communication channels. For confidential documents we offer secure transmission channels on request. Time-critical or legally significant notices are deemed received only once we have confirmed receipt.
9. Liability
To the extent permitted by law, we exclude all liability for damage arising from accessing the website, its use or unavailability, or from reliance on its content. This applies in particular to indirect damage, consequential damage and lost profit. Liability for unlawful intent and gross negligence remains reserved, as does any further liability that cannot be excluded by law. For calculators, assessments and guides, section 3 also applies. The liability regime of any marketing mandate remains unaffected by these terms of use.
10. Data protection and cookies
How we process personal data is described in the Privacy Policy. The use of cookies and similar technologies is described in the Cookie Policy.
11. Changes to these terms
We may amend these terms of use at any time. The version published on this page at the time of use applies. We will make significant changes visible in an appropriate place.
12. Final provisions
Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected; the invalid provision shall be replaced by a valid provision that comes as close as possible to its economic intent. These terms exist in German and English; in case of discrepancies the German version prevails.
Swiss law applies, excluding conflict-of-law rules. The exclusive place of jurisdiction for disputes arising from or in connection with the use of this website is Zurich, Switzerland – mandatory statutory places of jurisdiction remain reserved.
